Terms of Service

1. Introduction

These Terms of Service (“Terms”) constitute a binding legal agreement between you (“User,” “you,” or “your”) and Ascendant Studio (“Company,” “we,” “us,” or “our”), the owner and operator of the WallShift mobile application (“WallShift,” “App”). By accessing, installing, or using WallShift, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you must not use WallShift.

2. Eligibility

WallShift is intended for use by individuals who are of legal age to enter into binding agreements in their jurisdiction, or, if considered a minor under local law (including individuals under the age of 13), only with the consent and under the supervision of a parent or legal guardian. By using WallShift, you represent and warrant that you either (a) are of legal age in your jurisdiction, or (b) have obtained all necessary permissions from your parent or legal guardian to use the App and to agree to these Terms, in accordance with applicable regulations and Google Play policies pertaining to age restrictions and parental consent.

3. Use of the App

• User accounts or logins are neither required nor permitted for the use of WallShift. All access, including to paid functionality, is managed exclusively through the App and verified via the Play Store purchase process.
• You agree that you will not upload, use, or distribute through WallShift any materials or content that are unlawful, infringing, abusive, defamatory, obscene, or otherwise objectionable under applicable law.
• The use of WallShift to access, store, distribute, or facilitate content involving child sexual abuse material (CSAM), any illegal content, or content to which you do not hold the requisite legal rights (including, but not limited to, copyrighted material without authorization) is strictly prohibited and will result in immediate termination of access, and may be reported to law enforcement authorities.
• You shall not, nor shall you permit or facilitate any third party to, reverse engineer, decompile, disassemble, modify, or otherwise attempt to derive source code, algorithms, or underlying structure of the App or any of its components.
• You agree not to attempt to circumvent, disable, or otherwise interfere with any security-related features or technical limitations of WallShift.
• The Company reserves the right, at its sole discretion and without prior notice, to suspend or terminate your access to WallShift in the event of any actual or suspected violation of these Terms.
• Third-Party Content, Including Reddit: The App enables users to access and display images and content from third-party sources, including Reddit. Ascendant Studio does not control, monitor, or verify the origin, license, or copyright status of images retrieved from Reddit or other external sources. The use of any such content is at your own risk, and you are solely responsible for ensuring that your use does not violate applicable copyright laws or third-party rights.
• Reddit API and Trademark Disclaimer: WallShift is an independent application and is not affiliated with, endorsed, or sponsored by Reddit, Inc. All Reddit trademarks, logos, and content remain the property of Reddit, Inc. Features that access Reddit are provided "as is" and are subject to Reddit's own terms of service and API terms. Use of Reddit features via WallShift is conditioned upon compliance with Reddit’s platform policies. In the event that Reddit requests restriction or removal of features, or if your use of Reddit content violates Reddit’s terms, such features may be suspended or discontinued at our sole discretion.
• Commercial Use and Paid Features: WallShift offers paid plans and advertisements that are unrelated to Reddit features or content. Access to Reddit features is provided equally to all users, regardless of subscription or payment status, and no paid feature alters, enhances, or restricts access to Reddit content. Ascendant Studio does not monetize, charge for, or provide premium access to Reddit features. Users acknowledge that any use of Reddit services via WallShift remains subject to Reddit’s own terms and conditions, including but not limited to Reddit’s API Terms of Use. Ascendant Studio is not responsible for any breach of Reddit’s terms by users, and users agree to indemnify and hold harmless Ascendant Studio for any claims, liabilities, or damages arising from their use of Reddit services via WallShift. Ascendant Studio reserves the right to restrict, suspend, or remove access to Reddit features at any time, without notice, in response to requests from Reddit or upon breach of applicable terms.

4. Intellectual Property

• WallShift, including but not limited to its software, design, branding, text, graphics, and other content (excluding user-supplied images), is and shall remain the sole property of Ascendant Studio or its respective licensors. All rights not expressly granted herein are reserved.
• You may not, except as expressly permitted by law or with the prior written consent of Ascendant Studio, copy, reproduce, distribute, modify, publicly display, publicly perform, or create derivative works of any portion of WallShift.

5. User Content

• You retain all rights to images and content you select or use with WallShift, provided you hold the necessary rights and permissions to do so. You are solely and entirely responsible for ensuring that any content used within WallShift does not infringe upon any copyright, privacy, or other proprietary rights of third parties.
• Ascendant Studio neither claims ownership of, nor assumes responsibility for, user content, but reserves the right to remove or restrict access to any content that is alleged to violate law or these Terms upon notice or at its discretion.
• No Liability for Third-Party Content: Ascendant Studio expressly disclaims any and all liability related to the use, display, or access of third-party content, including images sourced from Reddit. You acknowledge that images and content retrieved via WallShift from external sources are not stored, downloaded, or otherwise retained by the App, and that their display is temporary and solely for the purpose of providing live wallpapers. Any claims regarding copyright infringement, trademark violation, or misuse of third-party content must be directed to the original source platform or content owner.

6. Paid Features and Purchases

• Certain features of WallShift may be made available only upon payment of applicable fees, which are processed exclusively through the Play Store. All payments, refunds, and billing disputes are governed by the Play Store’s terms and policies. Payments made after a free trial period, if applicable, are not refundable except as required by law or unless otherwise expressly stated in these Terms.
• Ascendant Studio reserves the right, without prior notice, to modify the availability, features, or pricing of paid or premium offerings at any time.
• Access to paid or premium features may be suspended or revoked without refund in the event of a breach of these Terms or applicable law.

7. Limitation of Liability

• WALLSHIFT IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, ASCENDANT STUDIO EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF INFORMATION.
• IN NO EVENT SHALL ASCENDANT STUDIO, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF USE, DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE WALLSHIFT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
• Users under the legal age of majority in their jurisdiction are advised to use the App only with the supervision of a parent or legal guardian. Ascendant Studio disclaims any liability for exposure to or use of content accessed through external links or sources that may be unsuitable for minors. Responsibility for supervision and content access restrictions rests solely with the parent or guardian.
• Some jurisdictions do not permit certain limitations or exclusions of liability; in such cases, our liability shall be limited to the maximum extent permitted by applicable law.
• Third-Party Services and Content Disclaimer: Ascendant Studio is not responsible or liable for any claims, damages, or disputes arising from your use of third-party services or content accessed via WallShift, including but not limited to Reddit. Users are solely responsible for compliance with all applicable terms, conditions, and legal requirements of third-party platforms and content providers. Ascendant Studio reserves the right to restrict or remove access to any third-party features at any time, without notice, in response to requests from such platforms or upon breach of applicable terms.

8. Termination

Ascendant Studio reserves the right to suspend or terminate your access to WallShift, at its sole discretion and without prior notice, for any reason, including but not limited to actual or suspected violation of these Terms or applicable law. Upon termination, all rights granted to you under these Terms shall immediately cease.

9. Dispute Resolution and Governing Law

• Any disputes, claims, or controversies arising out of or relating to these Terms or your use of WallShift shall first be attempted to be resolved amicably and informally by contacting Ascendant Studio at the email address provided below.
• Should informal resolution fail, any disputes or claims arising out of or relating to these Terms or your use of WallShift shall be resolved by binding arbitration. You may opt out of arbitration by providing written notice within 30 days of your acceptance of these Terms, including your name, email, postal address, and a clear statement of your decision to opt out.

10. Changes to These Terms

Ascendant Studio reserves the right to modify, amend, or update these Terms of Service at any time, at its sole discretion. Any such modifications shall become effective immediately upon being made available within the App or by updating the effective date indicated above. It is the responsibility of the user to review these Terms of Service periodically. Continued use of WallShift following any such modifications constitutes acceptance of the revised Terms of Service.

Third-Party Feature Changes: In the event that third-party platforms, including Reddit, modify their terms, restrict access, or require the removal of features, Ascendant Studio may update, suspend, or discontinue related features at its sole discretion. Continued use of such features is conditioned upon compliance with both these Terms and the external platform’s own terms.
